These Terms of Service ("Terms") are a binding legal agreement between you and Orhun Kavraz, an individual based in Türkiye operating under the name ELEN Story AI ("we," "us," or "our"), governing your use of our website, apps, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. Our Privacy Policy, which explains how we handle your data, is incorporated by reference. If you do not agree to these Terms, do not use the Service.
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an ELEN Story AI account. Children may only use the restricted, child-facing features of the Service under the direct supervision of an authorized adult. If you are an educator, you may use the Service for adult-led content creation. You agree not to enter real student names or other personal information of students. Use of the Service for institutional purposes, or with official student records, requires a separate written agreement with us and all necessary authorizations.
You agree to provide accurate and current information when creating your account. You are responsible for all activities that occur under your account and for safeguarding your password and any parental PINs. Notify us immediately if you suspect any unauthorized use of your account.
ELEN Story AI provides tools to generate creative content. The Service and its features may change over time. AI-generated content is created by complex systems and can be unexpected, inaccurate, or inappropriate. While we use safety filters, they are not perfect. You MUST review all AI-generated content before sharing it with a child or submitting it to the Community. The Service is for entertainment and educational purposes and is not a substitute for professional advice.
You retain ownership of the prompts you submit. You grant us a licence to use your content to operate, provide, and improve the Service. Creating a story does not publish it. When you separately submit a story to the Community, you grant ELEN Story AI a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt, edit, excerpt, translate, dub, distribute, publicly display and perform, and promote the submitted story and its generated images, audio, and video in the Community, our websites and apps, app-store listings, social and video platforms, advertising, and other ELEN Story AI marketing in any media. This promotional licence begins when you submit the story and continues while it is submitted or public and for a reasonable period needed to stop scheduled or active uses after you unpublish it. We may retain records and backups, and materials already released, cached, reposted, or retained by third-party platforms may remain available. You confirm that you are an adult, have the rights needed to grant this licence, and have removed personal or sensitive information, especially information identifying a child. No compensation is owed for these uses unless we separately agree in writing. Subject to these Terms, we grant you a limited licence to use the content you generate for personal, family, or educational purposes. You may not resell the Service or commercially exploit generated content without our written permission.
The Service itself, including our software, branding, and designs, is owned by ELEN Story AI or our licensors and is protected by intellectual property laws. You agree not to copy, modify, or create derivative works from the Service. You also agree not to use the Service to infringe on the intellectual property or other rights of third parties.
You agree not to use the Service to create harmful, illegal, or abusive content; attempt to bypass safety measures; harass others; impersonate anyone; infringe on rights; transmit malware; disrupt the Service; or use automated scrapers without permission. Violating these rules may result in account suspension or termination.
We may offer free and paid plans. By purchasing a subscription or credits, you agree to the pricing and payment terms presented to you. Subscriptions may auto-renew unless you cancel. You can cancel your subscription through your account settings or the relevant app store. IMPORTANT: Deleting your ELEN Story AI account does not automatically cancel your subscription if you purchased it through the Apple App Store or Google Play Store. You must manage and cancel such subscriptions directly through those platforms.
Our data practices are described in our Privacy Policy and Children's Privacy Notice. By using the Service, you acknowledge our collection and use of data as described in those documents.
You are solely responsible for the content you generate and choose to share with a child. Child profiles are data-minimized and do not permit children to create content or enter free text. You must review all AI-generated content for age-appropriateness and safety before showing it to a child. ELEN Story AI is not liable for any content generated from your prompts.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE OR SAFE. TO THE FULLEST EXTENT PERMITTED BY LAW, ELEN STORY AI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS DO NOT EXCLUDE ANY LIABILITY THAT CANNOT BE EXCLUDED BY APPLICABLE LAW.
You agree to indemnify and hold harmless ELEN Story AI from any claims, damages, and costs arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
You can stop using the Service and delete your account at any time. We reserve the right to suspend or terminate your account if you violate these Terms, create a security risk, or fail to pay fees. Provisions that by their nature should survive termination will do so, including those related to liability, disclaimers, and intellectual property.
We may modify these Terms from time to time. If we make material changes, we will provide you with notice through the Service or other means. By continuing to use the Service after the changes become effective, you agree to the revised Terms.
Before filing a formal claim, you agree to try to resolve the dispute informally by contacting [email protected]. These Terms are governed by applicable law, and disputes may be brought before courts that have jurisdiction under that law. Nothing in these Terms removes mandatory consumer rights, remedies, or venue protections that cannot lawfully be limited.
These Terms, along with our Privacy Policy and Children's Privacy Notice, constitute the entire agreement between you and ELEN Story AI. If any part of these Terms is found to be unenforceable, the remaining parts will remain in full effect. Our failure to enforce any right is not a waiver of that right.
